THE PARTS

Between the client, acting directly, if a natural person, or through a person duly authorized to act on behalf and representation, if a legal person; and on the other hand, DELLATERRA.CO, hereinafter Spataro Napoli SAS, a corporation duly incorporated in accordance with Colombian law, identified with NIT 890.312.535-7, owner of the website WWW.DELLATERRA.CO, buys and sells products and/or services as appropriate in accordance with the terms and conditions indicated in this document.

DELLATERR.CO will assume in good faith that it is contracting directly with the client or with his legal representative duly authorized to carry out this type of operations and DELLATERR.CO will not assume any responsibility for any impersonation carried out by any client.

Purchases made through the website must be made by persons of legal age. In the event that the purchase is to be made by a minor, the express and verifiable authorization of his or her parents must be obtained. Likewise, the receipt of the products must be made by one of the parents or an adult duly authorized to sign for receipt of the product.

FIRST PARAGRAPH: To make any purchase, it is essential to identify yourself as a customer on the website, where you will provide your personal and contact information, shipping and payment address and other information necessary to process the payment and shipping of your product(s).

The contract for the sale of products through our online Portal is formalized when the customer selects the product, accepts the terms and conditions, accepts the data processing policy and provides the necessary data to process their payment and the subsequent delivery of the products. Once the customer clicks the "buy now" button or its equivalent with which the purchase process is completed, said sales contract will be deemed to be concluded.

Proof of the formalization and conclusion of the sales contract will be deemed to have been provided with an "order receipt confirmation" email or a similar message. DELLATERRA.CO will inform or publish the transportation and shipping rate for the merchandise, which will be generated depending on the costs, items and policies of the transportation company, which are independent, autonomous and unrelated to DELLATERRA.CO. The cost of freight takes into account the location of the territory to which the purchased products must be sent, their size and weight. Payment will be made solely and exclusively by the following means:

2. Other payment methods: Mercado Pago, Apple Pay and Paypal.
3. Discount coupons: Corresponds to a coupon code that is not marketable or transferable, as it constitutes a benefit delivered to specific recipients and in the exercise of the sole discretion of DELLATERRA.CO.
4. Redemption coupon: Equivalent to a discountable fee or debit note that is made available to the customer in a single purchase. In the event that said coupon is redeemed in a purchase for a value less than the total value of the redemption coupon, it will be understood that the excess is waived.

Before purchasing any product, the customer must accept the payment conditions of the corresponding price, according to the payment methods available on the website for payment and in accordance with the terms and conditions indicated here. Even though DELLATERRA.CO makes available to the customer a secure connection system for all purchase offers, in no case will it be responsible for failures in communications from banking or credit entities, or for damages caused to customers by an action or omission of said entities.

In accordance with the provisions of Article 47 of the Consumer Statute (Law 1480 of 2011), the customer may return the purchased goods within five (5) business days following the date of delivery of the same. To exercise the right of withdrawal, the customer must return the product to DELLATERRA.CO by the same means and in the same conditions in which it was received. At the time of coordinating the return of the product with the customer, the costs derived from its transport will be informed, specifying at that time who will be responsible for said transport costs.

In accordance with the provisions of the aforementioned Consumer Statute, the following cases are exempt from the Right of Withdrawal, and in accordance with the corporate purpose of DELLATERRA.CO:

- In contracts for the supply of goods made according to the consumer's specifications or clearly personalized.

- In contracts for the acquisition of goods for personal use (underwear, socks, swimsuits or others).

DEALLATERRA.CO will refund to the customer all amounts paid (excluding shipping costs) without the need to make discounts or withholdings for any reason, within a maximum period of thirty (30) calendar days from the moment the right was exercised.

The law establishes that in sales made through electronic commerce mechanisms, such as the Internet, and in which a credit card, debit card or any other electronic payment instrument has been used to make the payment, the participants in the payment process must reverse the payments requested by the consumer when he or she is the object of fraud, or corresponds to an unsolicited transaction, or the purchased product is not received, or the product delivered does not correspond to what was requested or is defective.

In order for the payment reversal to proceed, within five (5) business days following the date on which the consumer became aware of the fraudulent or unsolicited transaction or that he/she should have received the product or received it defective or not corresponding to what was requested, the consumer must submit his/her request to DELLATERRA.CO, through the customer service line (2)-4893049 Ext 173 (Monday to Friday from 8am-5pm), or through our email hola@dellaterra.co, or through the returns form on our website http://www.dellaterra.co or through any other means that is enabled for such purposes. For this request, the customer must provide a photocopy of his/her identity document or ID card, bank certificate of the account (Savings - Current).

The result of the payment reversal request (Applicable or Inapplicable) will be informed to the client by email. If the payment reversal is appropriate, the documents and/or additional information that must be provided to advance the reversal process will be indicated.

Additionally, for the reversal process, the customer must return the product (in cases where it is in their possession), applying the provisions of our "Shipping, exchange and return policy".

Within this procedure, the claim will be notified to the issuer of the electronic payment instrument used to make the purchase, which, together with the other participants in the payment process, will proceed to reverse the transaction to the buyer. In any case, by accepting these conditions, the customer declares that he understands that the reversal of the payment is subject to the conditions of the bank or entity used to make the payment.

When using the Mercado Pago payment gateway and exclusively for payment by credit card, there is a possibility that, on the same day of the purchase, the customer clicks the "Order cancelled" button or another equivalent, which will reverse the transaction through the same Mercado Pago payment gateway. This reversal will be reflected within 5 days following your request and in any case will be subject to the terms and conditions that you will find on the Mercado Pago website.

All payments made through the Mercado Pago payment gateway accept the terms and conditions of said gateway.

By requesting a refund, the customer accepts that he/she is not responsible for the purchase made and therefore for the product(s) acquired; he/she also accepts DELLATERRA.CO's refund policies, so that, upon receiving the payment, the customer releases DELLATERRA.CO from all responsibility, being free and clear of all liability. Likewise, the customer accepts and declares that the information provided for the purposes of refunding money is real, complete and true. Likewise, with his/her refund request, the customer accepts DELLATERRA.CO's personal data protection policy and therefore what is expressed in Law 1581 of 2012.

The products will be shipped through an independent transportation company duly authorized to provide such service. The maximum term for the delivery of the products will be ten (15) business days, counted from the approval of the payment, provided that there is no fortuitous event or force majeure, among which are, by way of example: acts of man or nature, strikes, stoppages, revolutions, rebellion, sedition, riots, attacks, power cuts, landslides, earthquakes, avalanches, floods, bridge collapses, among others.

The destination of the shipment will be the one indicated by the customer at the time of purchase, which may be the buyer's place of residence or another one designated by the buyer. It is understood that any person of legal age who is at the indicated shipping address is duly authorized by the customer to receive their order, so DELLATERRA.CO is exempt from any liability at the time of delivery made by the transport company, as long as it is made to the shipping address registered at the time of purchase on the website.

PARAGRAPH: The transport company will make a maximum of three (3) attempts to deliver the purchased products to the shipping address registered by the customer at the time of purchase. If the delivery attempts are unsuccessful, the merchandise will be returned to the DELLATERRA.CO facilities. The customer will be contacted to schedule a new delivery.

If it is not possible to arrange delivery of the product, it will be stored for a maximum period of six (2) months, during which time the customer must contact ENZOFELDINISTORE.COM, through the channels established in this document, to arrange its withdrawal at a physical point established by DELLATERRA.CO or provide a new shipping address, the costs of which will be informed to the Customer.

Once the maximum storage period mentioned above has been met, DELLATERRA.CO will not be responsible for the product.

The document equivalent to an invoice will be sent to the email provided by the customer at the time of purchase.

The client or recipient of the good or product must refrain from receiving it immediately if the container or packaging of the product shows damage, breakage, openings or similar, leaving a proper note or record of such fact.

Products will be packaged and packed in such a way as to ensure proper transport. Product packaging and packing may vary for logistical or other reasons without prior notice, always ensuring optimal delivery and transport conditions.

The warranty covers obvious manufacturing defects, the warranty period is 90 calendar days. The warranty period is counted from the day the product is delivered to the customer. The warranty does not cover normal deterioration of the product, improper use, or damage caused by not following the instructions for care or maintenance of the products.

DELLATERRA.CO's customer service department will review the request and, if applicable, request the return of the product for review.

The collection of the product will be coordinated with DELLATERRA.CO or with the transport company that made the delivery, as indicated to the customer.

Based on the analysis carried out, a formal response will be generated to the client, informing them whether the warranty claim is valid or not.

In the event that the guarantee is valid, DELLATERA..CO will indicate the procedure to make it effective. In the event that the product guarantee claim is not valid, the customer will be explained the reasons why it will not be effective, returning the product(s) to the initial shipping address or to the address indicated by the customer.

In the event that the tailoring service is provided, the guarantee covers said service for a period of thirty (30) calendar days, counted from the delivery of the product.

The availability of spare parts, components, supplies and trained labor will be fifteen (15) calendar days, counted from the expiration date of the product warranty. The cost of this service will be assumed by the customer in accordance with the provisions of the Consumer Statute and other applicable legislation in force.

The client expressly declares, within the free exercise of his will, that the money with which he develops his corporate purpose and/or activity comes from lawful activities, that is, that it does not come from any illicit activity contemplated in the Colombian Penal Code or in any other concordant norm or that modifies or adds to it, for which reason DELLATERRA.CO is exonerated and relieved from any type of criminal, civil, tax and/or financial responsibility in this regard.

It also guarantees that neither its partners, shareholders, related parties or beneficial owners, in the case of a legal entity: (i) have been, or are included in any of the lists administered by the Office of Asset Control of the United States Department of the Treasury or any similar list; (ii) have no ongoing investigations, nor have they been indicted or convicted for drug trafficking, money laundering or terrorist financing; and, (iii) their assets, businesses and resources, as well as those of their shareholders, come from lawful activities.
